THE ICC DECISION RESPONDS TO THE REALITY OF THE FACTS

The International Criminal Court (ICC) has finally sentenced, this Thursday, the Israeli Prime Minister, Benjamin Netanyahu; the former Minister of Defense, Yael Gallant, and the Hamas leader, Mohamed Daif, for war crimes and crimes against humanity, as of October 8 of last year; a decision that has been received with fury and rejection in Israel.

In the world of jurisprudence there are two types of sentences: the one of a legal nature and the one that can be considered a moral sentence. The first involves the detention of the accused if they visit the countries that support the Court. Moral sentences are accepted by the entire world to qualify people or leaders, who without being detained, are responsible for crimes against humanity.

The crimes committed by Netanyahu and Gallant in Gaza are obvious: a genocide of the Palestinian population of the enclave, and a series of war crimes that have led to the destruction of that territory and the death of more than 43,000 Palestinians. It was practically impossible for the ICC not to attend to the accusations made by South Africa, Brazil and Spain, along with various non-governmental organizations.

Virtually Netanyahu and Gallant cannot visit the 124 countries that recognize the Court without being arrested; but it is possible that in some cases the principle of a moral condemnation is preferred. Israel and the United States do not recognize the ICC, while the Jewish Prime Minister has indicated that he “will continue to defend Israel”, which presupposes continuing the war in Gaza and the aggression on Lebanese territory.

The head of European diplomacy, Josep Borrell, has affirmed that the mandates of arrest must be "respected and enforced". "The court's decision must be respected and implemented," said Borrell at a press conference in Amman with his Jordanian counterpart, Aymane Safadi.

In Europe, several countries have supported the International Criminal Court. "Spain will conform to its commitments and obligations in the Statute of Rome government and international law," declared sources, underlining that this principle has been expressed on several occasions by the president of the government, Pedro Sánchez.

The Irish government said in a statement that it "strongly supports the ICC" and calls on "all states to respect its independence and impartiality, refraining from any attempt to undermine the Court." The Netherlands is preparing to execute the arrest warrants, the Dutch foreign minister also said.

Within the European Union, Austria is the first country to declare that if Netanyahu or Gallant enter its territory, they will not be arrested. Israel also maintains that the Court's decision "supports terrorism," an interpretation that in no way corresponds to reality, since the genocide in Gaza cannot be hidden.

Considering that the ICC's decision is of an "anti-Semitic" nature is the excuse that Israel always uses when it is criticized or condemned for its criminal acts. This expression is the "weapon" that the Hebrew state uses to defend itself, but it has long since ceased to be valid.

The Israeli army reported on Thursday, July 16, that the military chief of Hamas, Mohamed Deif, was killed in an Israeli air strike in the Gaza Strip... It is not known with certainty whether Deif was killed or is still alive.
